Wilmington Company Sues Adjacent Company for Alleged Release of Hazardous Waste and Contamination of Plaintiff's Property and Groundwater

JLM Industries, Inc. sued Southern Metals Recycling, Inc. and Metals USA Plates and Shapes Southeast, Inc. in New Hanover County Superior Court. After a July 2, 1998 massive explosion and fire at the adjacent metals recycling facility, JLM Industries, Inc. claims that it discovered hazardous substances, hazardous waste, hazardous chemical, and heavy metals contamination of their surface and subsurface of their property. JLM Industries, Inc. claims that the adjacent property owners committed and continue to commit wrongful and unlawful acts, and that such acts constitute a reckless disregard for the rights and safety of the plaintiff and it's property.
